Introduction

The Payment of Wages Act, 1936 was enacted to ensure that employees receive their wages on time and without unauthorized deductions. The Act protects workers from delayed payments and unfair wage deductions by employers.

2. Objectives of the Act

• Ensure timely payment of wages

• Prevent illegal and excessive deductions

• Provide a legal remedy for wage disputes

• Protect workers from exploitation

3. Applicability

• Applies to employees earning up to ₹24,000 per month (as amended)

• Covers persons employed in:

o Factories

o Industrial establishments

o Railways

o Shops and commercial establishments

• Applicable across India

4. Responsibility for Payment of Wages

• Employer is responsible for wage payment

• In factories: Manager

• In industrial establishments: Employer or person in charge

5. Wage Period

• Wage period must not exceed one month

• Wages must be fixed for daily, weekly, fortnightly, or monthly periods

6. Time of Payment

• Establishments with less than 1,000 workers:

Wages to be paid before the 7th day of the following month

• Establishments with 1,000 or more workers:

Wages to be paid before the 10th day of the following month

• On termination: Wages to be paid within 2 working days

7. Mode of Payment

• Wages to be paid in:

o Cash

o Cheque

o Bank transfer (digital payment allowed)

• No payment in kind except where permitted by law

8. Meaning of Wages

Includes:

• Basic salary

• Dearness Allowance (DA)

• Bonus

• Overtime wages

• Any remuneration payable under contract

Excludes:

• Gratuity

• Employer’s PF contribution

• Travel allowance

• Special expenses reimbursement

9. Authorized Deductions

Only authorized deductions are allowed, such as:

• Fines

• Absence from duty

• Damage or loss caused by employee

• PF and ESI contributions

• Income tax

• Loan recovery

• House accommodation charges

📌 Total deductions should not exceed 50% of wages

(75% if deductions include cooperative society payments)

10. Fines

• Fines can be imposed only for acts approved by the government

• Fine amount should not exceed 3% of wages

• Fines must be recorded in a register

• Employees must be given an opportunity to explain

11. Maintenance of Registers & Records

Employer must maintain:

• Wage register

• Deduction register

• Fine register

• Attendance register

Records must be preserved for 3 years

12. Claims & Legal Remedy

• Employees can file claims for:

o Delayed wages

o Illegal deductions

• Claims can be filed before the Authority appointed under the Act

• Authority can order:

o Payment of due wages

o Compensation up to 10 times the amount deducted

13. Inspectors

• Government appoints inspectors

• Inspectors can:

o Enter premises

o Examine records

o Question employees
