4. Important Definitions

a) Industry

Any systematic activity carried on by cooperation between employer and workmen for the production, supply, or distribution of goods or services.

b) Workman

A person employed in any industry to do manual, skilled, unskilled, technical, operational, or clerical work for hire or reward.

5. Industrial Dispute

An industrial dispute means any dispute or difference between:

• Employers and employers

• Employers and workmen

• Workmen and workmen

Related to employment, non-employment, terms of employment, or conditions of labour.

6. Authorities for Settlement of Disputes

a) Works Committee

• Required in establishments with 100 or more workmen

• Promotes good relations between employer and employees

b) Conciliation Officer

• Appointed by the government

• Mediates between parties to resolve disputes

c) Board of Conciliation

• Set up for specific disputes

d) Labour Courts

• Adjudicate matters related to dismissal, discharge, legality of strikes

e) Industrial Tribunals

• Handle wage disputes, bonus, working conditions

7. Strikes & Lockouts

Strikes:

• Temporary stoppage of work by workmen

• Prior notice required in public utility services

Lockouts:

• Temporary closure of workplace by employer

• Illegal if done without following due process

8. Layoff

• Temporary inability of employer to provide work

• Compensation: 50% of basic wages + DA

• Applicable to establishments with 50 or more workmen

9. Retrenchment

• Termination of service for reasons other than disciplinary action

• Employer must:

o Give 1 month’s notice

o Pay retrenchment compensation (15 days’ wages for every completed year)

10. Closure

• Permanent shutting down of an establishment

• Prior government permission required in large establishments

• Compensation payable to workmen

11. Unfair Labour Practices

Includes:

• Discriminatory treatment

• Victimization of workmen
